The privacy policy (“Policy”) is applicable to all online interfaces of Linking Spaces Technologies Pvt. Ltd. (“Linking Spaces”, “Settlin”, “us”, “we” or “our”) including settlin.in, mobile site/applications (whether under the brand name Settlin or by any other name so called) for iOS, Android, or any other operating system (collectively referred to as “Site”). This Policy describes how Settlin collects, uses, retains, maintains, shares, disposes of and protects user, customer and visitor information (hereinafter “user” or “you” or “your”) when you access and use the Site. This information may include but is not limited to any information you upload, emails exchanged with Settlin and other users of the Site and any information submitted/ provided by you to Settlin.

Why this Privacy Policy exists

This Privacy Policy ensures that we:

protect the rights of users, visitors and customers;
are open about how we store individuals’ personal data;
protect ourselves from the risk of a data breach.

You may provide us with some information when using the Site or availing any kind of services via Settlin including but not limited to creating an account on Settlin, submitting feedback, subscribing to Site updates. This information is necessary for performance of the agreement between you and us and to allow us to comply with our legal obligations. Without it, we may not be able to provide you with all the requested services.

In order to use certain features on the Site, Settlin may require you to create an account (“Account”) where we require may you to provide certain Personally Identifiable information such as your first name, last name, email address, date of birth, place of birth, phone number, interests, and depending on the nature of services you avail, information pertaining to your gender and marital status, and other information as thought fit to provide you with the best services. Depending on the service being availed, some of the information we ask you to provide may be identified as mandatory and some identified as voluntary.
To create and maintain a trusted environment or to be in compliance with local, state or central laws, we may collect certain Personally Identifiable Information in order to verify your identity, such as images of specified government issued identification, including AADHAR, passport, national ID card, or driving license, or any other information as may be required to verify your identity.
When you communicate with Settlin or use the Site to communicate with Settlin’s affiliates and authorised service providers/agents or when you communicate with other users of Settlin, we collect all such correspondence, information about your communication and any additional information you choose to provide.
You may choose to provide us with additional Personally Identifiable Information in order to obtain a better user experience when using Settlin, such as uploading of a profile photo, your additional interests, and other such information not mandatorily collected from the users as provided for in the above fields.

1.2. Information collected automatically by us

On each visit to the Site, we may automatically collect the following:

technical information, including the Internet protocol (IP) address used to connect your computer to the Internet, the User login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform; information about the visits, including the full Uniform Resource Locators (URL), clickstream to, through and from the Site (including date and time), products viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), methods used to browse away from the page, and any phone number used to call our customer service number.

Cookies are small data files that are stored on your device when visiting a website, which enable us to collect information about your device identifiers, web browsers used to access the services, pages or features viewed, time spent on pages, mobile app performance and links clicked.

1.3. Information, which is received from third-parties

This includes, but is not limited to our partners, sub-contractors in technical, payment services, advertising networks, or other third parties who may provide information, for the purpose of fulfilling the services to you, or to comply with legal requirements. We shall at all times, endeavour that our partners, sub-contractors in technical, payment services, advertising networks, or other third parties are to provide the same level of data protection and that they shall only carry out their contractual obligations towards us or upon our instructions and not for any other purposes.

When you use any payment services on the Site, certain financial information may be required to facilitate the processing of such payments. Please note that Settlin may engage with third party payment service providers in order to enable you to process your payments in connection with the use of Settlin’s services. You will be required by such third-party payment service providers to provide certain Sensitive Personal Information. Please note that to this extent, you will be subject to the terms of use and privacy policy that is maintained by such third-party service providers.

The Site may include social media features, such as the Facebook, Twitter widgets, etc. These features may collect your personal information and track your use of the Site. These social media features are either hosted by a third party or hosted directly on the Site. Your interactions with these features are governed by the privacy policy of the company providing such functionality.

In case of using a location-enabled device with the Site, we may collect location data or use various means to determine the location.

2. Use of Information

To provide and maintain our service- We may use your Personal Data to supply you with services required, to bill you and to contact you when required. We may also analyse the Personal Data provided to help in administering, supporting and improving the business, to provide, maintain, deliver and improve our services and obtain your views of the services, and to carry out any other purpose for which the information was collected. At all times, access to your Personal Data by our own staff and third-party intermediaries will be restricted to the bare minimum required for us to perform our business and the provision of the services to you.
To measure Site performance - We actively measure and analyse data to understand how our services are used. This review activity is conducted by our operations team to continually improve our platform’s performance and to resolve issues with the user experience. We continuously monitor our systems’ activity information and communications with users to look for and quickly fix problems.
To communicate with you - We use Personal Data collected, like an email address to interact with users directly when providing customer support on a ticket or to keep you informed on logins, transactions, and security. Without processing your Personal Data for confirming each communication, we will not be able to respond to your submitted requests, questions and inquiries. All direct communications are kept confidential and reviewed internally for accuracy. We may provide our users with user support through an online chat with an agent. Username and email address may be necessary to sign up for online chat. The data collected in this manner shall be processed exclusively for the purpose of providing user support. We may keep logs for internal and external audits; training and investigation including law enforcement agencies.
To notify you about changes to the Site, this Policy or the Terms of Use;
To detect and prevent fraud, spam, abuse, security incidents, and other harmful activity;
To conduct security investigations and risk assessments;
To verify or authenticate the information or identifications provided by you (such as to verify your accommodation address);
To conduct checks against databases and other information sources, including background or police checks, to the extent permitted by applicable laws and with your consent where required; or

Marketing of our services- We may periodically notify you of any new benefits or services being offered. You may always decide to opt out from receiving the above notifications and may cancel the service by sending an e-mail to [email protected].
To enforce our Terms of Use and other agreements - It is very important for us and our users that we continually review, investigate and prevent any potentially prohibited or illegal activities that violate our Terms of Use. For the benefit of our entire user base, we carefully enforce our agreements with third parties and actively investigate violations of our posted Terms of Use. We reserve the right to terminate the provision of service to any user found engaging in activities that violate our Terms of Use.
To comply with legal and regulatory requirements - Respect for the privacy and security of Personal Data you store with us informs our approach to complying with regulations, governmental requests and user-generated inquiries. We will not disclose or provide any Personal Data to third party sources without obtaining specific consent from you (unless any applicable law requires otherwise) and without review from our legal team.

3. Sharing and disclosure of your information:

We may share your Information Settlin’s affiliates, group entities and other persons, service providers and entities who help us provide services to you (e.g. accommodation provider, services partner, social community partner etc). We only share your information in accordance with the applicable law. To make our process of sharing more clear, here is a list of avenues where your Information may be shared for the purposes set out in this Policy:

Within Linking Space’s group companies and affiliates in relation to its business purposes;
With authorised Third Party Service Providers- Settlin may provide products and services through third parties, including without limitation, your background verification, advertising and payment services and many more. We may share Personally Identifiable Information with such third parties in order to fulfil orders, complete move in and move out data, solve issues and troubleshoot, and provide customer service. We may also provide personal information to individuals and companies with whom we have business relationships and may share your information with Third Party Service Providers to accomplish our administrative tasks. However, the use of your Personally Identifiable Information by such parties is governed by the privacy policies of such parties and is not subject to our control.
With persons/entities that own/ manage other applications or websites that integrate with our API or services, or those with an API or service with which we are integrated or choose to integrate in future;
Settlin lets you publish information, including personal information, that is visible to the general public. For example, blog comments, parts of your public profile page, social media posts, your feedback or testimonials, or other features of our services that are obviously viewable by the general public;
Third parties where we have a duty to or are permitted to disclose your Information by law (e.g. law enforcement officials, government authorities);
With the police in the exercise of their functions or with others as required by a court order or for police verification purposes before occupying of a living space;
As with any other company, we could merge with, or be acquired by another company. If this occurs, the successor company would acquire the information we maintain, including Personally Identifiable Information. However, Personally Identifiable Information would remain subject to this Policy.

4. International transfers

Your personal information may be transferred to or from any locations outside of your state, province, country or other governmental jurisdiction where Settlins’s Sites and/or databases are operated and managed By using and accessing the Site, you consent to the transfer to and processing of your Information including the Sensitive Personal Information and the Personally Identifiable Information, on servers that may be located in a jurisdiction different from where you are located, and that the protection of such Information may be different than required under the laws of your residence or location.

5. Age

The Site is only intended for users who are competent to contract under applicable law. If you are not of the requisite age, you are not supposed to provide any Personally Identifiable Information or Sensitive Personal Information. If it comes to Settlin’s attention that any such information pertains to an individual who is not competent to contract under applicable law, such Information may be deleted without notice to you.

We shall keep Personal Data that is adequate, relevant, and limited to what is necessary in relation to the purposes for which it is processed and reduce any risks relating to your data by maintaining it in a safe and secure manner.

We strive to keep Personal Data accurate, and, where necessary, it is to be kept up to date. We shall take reasonable steps to ensure that Personal Data is accurate, having regard to the purposes for which it is processed, and any inaccurate Personal Data shall be erased or rectified without undue delay.

Please note that it is impossible to guarantee 100% secure transmission of data over neither the Internet nor any method of electronic storage. As such, we request that you understand the responsibility of independently taking safety precautions to protect your own Personal Data. Settlin does not take any responsibility for you or any third party circumventing the privacy settings or security measures contained on the Site.

While Settlin will use all reasonable efforts to ensure that your Information is safe and secure, it offers no representation, warranties or other assurances that the security measures are adequate, safe, fool proof or impenetrable.

If you suspect that your Personal Data has been compromised, please contact our customer service immediately on [email protected]. You acknowledge that you are responsible for all acts done, using your Account login credentials. Settlin is not responsible if someone else accesses your Account on account of your failure to maintain security of your Account credentials.

Upon request, and within the limits allowed by applicable law, you have the right to have your Personal Data erased by us by writing to us at [email protected].

7. Your rights

You may update, rectify, erase, or transmit your Personal Data, if appropriate or as required by law through your Account settings. Please note that you do not have the option to connect to third party applications using your Account. Do note however, Settlin reserves the rights to save any Non-Personal, Device Information and usage Information and you are not entitled to seek the deletion of the same. Settlin at its sole discretion may permit or deny the change of any Information, if it is believed such Information is required to comply with applicable laws.

8. Retention of data

We ensure that your Information will not be kept for longer than is necessary and/or as may be required under law, and only kept for the purposes for which it is processed. However, there may be circumstances that mean we must retain your personal information for longer (e.g. in the event of a dispute or if you make a claim in relation to a booking). Retention periods may however vary for the use of information for carrying out of our legitimate business interests or as required for ensuring legal compliances. Information you have shared with others (e.g. reviews, forum postings) may continue to be publicly visible on the Site, even after your Account is cancelled.

As Settlin evolves, there may be the need to update this Policy to keep pace with changes to the Site, services, business and applicable laws. We will however, always maintain our commitment to respect your privacy. We will ensure that we will notify you about any material changes under this Policy by posting any revisions to this Policy along with their effective date, in an easy-to-find area of the Site.
